Asthma Lawsuit Settlements

Asthma settlements can cover medical costs, lost wages, future expenses, as well as attorney's fees. The lack of care that causes occupational asthma can cause serious and debilitating consequences for the affected worker.

2. Lehigh County

The lawsuit claimed that PrimeCare medical personnel ignored warning signs of breathing problems and required prisoners to go to the hospital for Albuterol mini-nebulizer treatments instead providing them with inhalers for rescue to keep in their cells. The terms of settlement were kept secret. In a different case, a jury awarded $55,000,000 to the parents of an infant who suffered brain damage when she was delivered at St. Luke's University Hospital Allentown. The verdict was the biggest ever recorded in Pennsylvania for medical malpractice.

3. Crozer Chester Medical Center

CROZER CHESTER MEDICAL CENTER, located in UPLAND is a hospital providing the short-term acute treatment. Its rating is 3. The list of medical professionals includes 665 doctors. The hospital was established by Crozer Health System in 1963.

It is one of the region's most recognizable and advanced clinical facilities providing a full spectrum of medical and surgical services. It is a school that educates the next generation of healthcare and medicine through its residency, undergraduate, Asthma Lawsuit Settlements and fellowship programs.

In January 2018, an unintentional admission to the Crozer Chester medical center was made for urgent mental health care. He was not allowed to consult with his own physician or talk to his family before being transported to a hospital. The lawsuit asserts that this violated plaintiff's constitutional rights and state law as well as statutory rights.

The lawsuit settlement will address the alleged air pollution violations at the hospital's medical waste incinerator. The hospital will implement an Asthma cancer awareness and management program in public schools within the Chester-Upland School District. Statoil Energy Power Inc. is also required to pay a fine of $250,000 as part of the settlement. Statoil will employ a registered nursing assistant and an asthma manager to run the program for two years.

4. Statoil Energy Power Inc.

The company was able to pay a fine for administrative violations and establish a program for asthma detection and treatment in the Chester-Upland Public Schools. It must also teach its employees to recognize the signs of an attack and respond appropriately. It will recruit an Asthma railroad cancer nurse and care manager to oversee the two-year asthma care program.

The lawsuit was filed in 2019 by the family of an asthmatic student who died on the campus. Adilene Carrasco, who was 13 at the time, walked with her classmates to a sports field at Mesa View Middle School east of Los Angeles on October 31 for an Halloween "pumpkin throwing contest". She wore an inhaler to reach the field, but was experiencing breathing problems on the return trip. The lawsuit alleged that she was sent back to class with a student without determining whether she was fit to do so.

The Yucaipa Calimesa Joint Unified School district has not admitted to any wrongdoing. However, it has agreed with the California School Board Association to adopt the best methods for students with medical illnesses. They will also work with pulmonologists in order to train staff on how to treat asthma in children. According to Robert Glassman, the lawyer for the family, the district will also make changes to its safety procedures for students with medical conditions.
