Asbestos

She claimed that the railroad exposed Mr. Payne negligently to asbestos radioactive material, asbestos and diesel exhaust.

The jury gave Mrs. Payne $8.6 million in her wrongful death lawsuit against CSX in November of 2010 following a two week trial in Knoxville, Tennessee. CSX appealed and the case was heard by the Tennessee Supreme Court.

Diesel Exhaust

Trains powered by diesel fuel produce lots of exhaust fumes which pollute the air. These fumes are loaded with toxic chemicals that can harm the lungs and skin. They also trigger respiratory illnesses and lung cancers among railroad workers. These conditions are made more severe because of the poor ventilation in areas like engine cabins. Conductors and engineers are the most vulnerable to these issues since they spend a large portion of their time in cabs.

Several studies indicate that exposure to diesel exhaust may increase the chance of developing lung cancer independent of smoking. These findings are based upon epidemiological studies conducted on humans as well as animal research. The International Agency for Research on Cancer and the World Health Organization have classified diesel exhaust as carcinogenic to humans.

Excessive exposure to diesel exhaust can increase the risk of lung cancer compared to other occupational exposures like asbestos and coal combustion. Diesel exhaust is loaded with toxic components that irritate the lungs and increase cancerous cell incidence.

Studies that link the exhaust of diesel to lung cancer in railroad workers have been conducted for many years. Railroads were aware of the dangers that come with this chemical exposure. Court records show that an Chesapeake and Ohio Railroad claims manager warned other railroad officials in a meeting in 1955 about the cancer-causing dangers of diesel exhaust.

Fear of Cancer

Railroad workers must work near tracks and vehicles that carry 30 million people and 1.6 billion tons of freight every year, including food, vehicles and crude oil and lumber, grain chemicals, metal ore and many more. These shipments may expose them to toxins which increase their risk of lung cancer.

Thurston Hensley sued his employer CSX under the Federal Employers' Liability Act for inhaling asbestos and suffering from the asbestosis. Hensley also sought damages for his fear of developing cancer in the future. csx transportation mesothelioma said the trial court erred by not giving a jury instruction that defined the standard for awarding damages for cancer fear as defined in the Supreme Court decision in Norfolk & Western Railway Co. v. Ayers.

The Supreme Court agreed and overturned the $5 million verdict.
