Monk, a former psychiatrist, has claimed that discrimination from VA has led him, and other black vets to suffer in a way that has affected their health, home life, employment, and education. He demands that the agency repay him for the benefits that it has taken him out of and to alter its policies on race, discharge status and denial rates.

Monk and the Veterans Legal Services Clinic received 20 years of VA disability claim information last year through Freedom of Information Act request that they submitted on behalf of National Veterans Council for Legal Redress, and the Black Veterans Project. The results showed that Black Veterans Disability Lawsuit were statistically less likely to be granted an appeal for disability than white veterans between 2001 and 2020. The average denial rate for black veterans was 6.3% higher than for white veterans disability claim.

Discrimination in PTSD

According to a lawsuit filed Monday in the United States, the Veterans Affairs Department denies disability benefits to Black veterans. This "bad paper" hindered him from receiving the home loan, tuition assistance and other benefits.

He sued the military to reverse the discharge and was awarded full benefits both in 2015 and in 2020. However, he claims the VA still owes him money for his previous denials of disability compensation. The suit also claims that he suffered emotional harm by reliving his most traumatic experiences with each and every application for benefits.

The lawsuit seeks monetary damages and seeks the court's order for the VA to review its systemic PTSD discrimination. It is the latest effort by groups like the ACLU and Service Women's Action Network to force the VA to address long-running discrimination against survivors of sexual assault.
