Railroad workers have been exposed like diesel exhaust, asbestos and welding fumes. These toxic exposures can cause serious medical conditions, such as occupational lung cancers and industrial lung diseases.

Winston Payne was a brakeman/switcher for CSX for 40 years. His estate won a large jury verdict after he died from lung cancer. CSX appealed the verdict.

Asbestos

Asbestos is a group of naturally occurring minerals that were popular in construction for their fire-resistant, corrosion-resistant and insulate properties. Inhaling asbestos fibers could increase the risk of developing serious health problems. These include lung cancer, mesothelioma (a deadly form of cancer that develops in the lining that protects various organs) and asbestosis (a scarring of the lungs). After exposure, symptoms may not appear for 15 to 30 years.

Asbestos exposure can lead to a variety of ailments, ranging from mild mesothelioma to pleural plaques, an uncommon cancer that develops in the lining of the lungs, the heart, and abdomen. Mesothelioma is only detected after it has spread across the body. This makes the treatment more difficult.

If a person suffering from mesothelioma or another asbestos-related disease is experiencing symptoms, he/ should see a doctor immediately. The doctor can determine how severe the illness is and how much exposure there was. Doctors can prescribe medication to manage the symptoms. The most commonly prescribed medication to decrease inflammation is corticosteroid. A doctor may prescribe antibiotics for respiratory infections. Asbestosis is a risk factor for respiratory complications, like the flu or pneumonia. It is crucial to immunize those suffering from asbestosis against these illnesses.

Radiation

CSX Corporation offers rail-based transportation throughout the United States. The company has 20000 route miles of track across 23 states and the District of Columbia. Diesel Exhaust

These findings are based on human epidemiological studies as well as animal studies. The International Agency for Research on Cancer and the World Health Organization have classified diesel exhaust as carcinogenic to humans.

Diesel exhaust exposure may increase the risk of developing lung cancer, compared to other occupational exposures such as asbestos and coal combustion. The increased risk is attributed to the presence of toxic elements in diesel exhaust, which can cause irritation to lung tissue and increase the number of cancerous cells.

Over the years, research has been conducted to prove the connection between the exhaust of diesel engines to lung cancer among railroad workers. The railroads were aware of the dangers associated with this chemical exposure. Court records reveal that a Chesapeake and Ohio Railroad claims manager warned other railroad managers at a conference in 1955 of the dangers to cancer of diesel exhaust.

Fear of Cancer

Railroad workers are required to work near the tracks and automobiles that transport 30 million people and 1.6 billion tons of freight every year. This includes food, cars including crude oil grain, lumber, chemicals, Csx Transportation Throat Cancer metal ore and many more. Thurston Hensley sued his employer CSX under the Federal Employers' Liability Act for suffering from asbestos exposure and the asbestosis that resulted. Hensley sought pain and suffering damages that included his fear of developing cancer in the near future. CSX asserted that the trial court erred by not providing a jury instruction to define a standard for awarding damages for cancer-related fear as defined in the Supreme Court decision in Norfolk & Western Railway Co. v. Ayers.

The Supreme Court agreed, and upheld the $5 million verdict.
