What Is Veterans Disability Compensation?

The Department of Veterans Affairs awards compensation based upon the degree of your service-related disability or impairment. VA Regional Offices look at the combination of records from treatment for service, private medical records, and other pertinent information.

Some severe injuries, like losing a leg, being blind in both eyes, or hospitalized, merit higher compensation. These are known as Special Monthly Compensation (SMC).

Eligibility

VA disability compensation is a tax-free monetary benefit granted to eligible veterans disability legal, spouses, and children. The amount of the compensation is determined by the condition of the Veteran and the extent of disability, based on the guidelines set by Congress.

The person who is entitled to benefits if they suffer from an illness, injury or event that has aggravated or caused the condition of a medical issue that is related to service. You may be eligible for disability compensation if you had a pre-existing medical condition, but it must be proven that the injury, illness, or event occurred in service.

The severity of a person's illness is rated by a percentage which is used to determine the amount they could receive in monthly benefits. This rating is based on an internal review of treatment records and VA records as well as private medical records regarding the condition.

The rating system will also consider whether or not a person is unable to do "substantially lucrative" employment. It is essential to remain in contact with the VA regarding any tests they request, and to attend the examinations on time, as failing to do so could negatively impact your case.

Benefits

Typically those who are connected to the military for ailments that affect their daily activities can be eligible for compensation payments to help offset their losses. These are tax-free financial rewards.

The amount you will receive will be determined by the degree of your disability. You can be compensated in the event of a single disability, or multiple disabilities. If you have more than one disability, your rates will be combined by an algorithm that takes into account each condition.

You could be eligible for additional benefits, including Dependency and Indemnity Compensation (DIC) or Special Monthly Compensation (SMC). DIC is given to children, spouses, or parents of deceased veterans disability lawyers (watch this video) who died while on active duty or during training, or as a result of a service-connected disability. SMC is paid to disabled veterans disability lawyers and their children and spouses based on need for aid and Veterans Disability lawyers attendance.

The SHA grant program offers financial assistance for disabled veterans that want to make changes to their homes in order to continue treatment and ensure accessibility. Modifying their current residence, or buying a house that is specially designed to accommodate disabilities, are all options. This is a federally funded program that does not require an VA or SSI/SSDI based decision.

Rates

Based on the extent of your illness or injury depending on the severity of your injury or illness, the VA may give you between 0% and 100% disability compensation. This compensation is designed to provide you with a financial incentive for the period that your disability stops you from working. It does not include benefits such as dependent's benefits, which are available separately.

The VA will review your current medical condition and any evidence indicating an association between your illness or injury sustained in service and your current health condition. They use a scale to assess disabilities, and each one is assigned a percentage of how healthy you would be if you did not have the handicapping condition. For instance, if the medical condition is judged to be 10 percent disabled, your total rating would be 10% of 100% (the "healthy" percentage).

Requirements

If you suffered injury or became sick during active duty, you could be eligible for disability compensation. This includes ailments such as tinnitus, which was developed following exposure to gunfire or a loss of limb resulting from an IED explosion. Spouses and children of veterans can also receive Dependency and Indemnity Compensation (DIC) if they die as a result of service-related causes.

You must satisfy the medical nexus criteria to be eligible for these benefits. If you have been bothered by a bent ankle since boot camp, for instance, you may qualify as being disabled.

You must be a former veteran with a valid discharge. It can't be unhonorable. You won't be admissible to benefits if your discharge was the result of willful misconduct. However, many other discharges will qualify you for compensation for veterans. Finally, you must have an impairment that hinders your ability to maintain a productive employment.

Timeframe

To be eligible for an income-based compensation benefit, the VA must determine whether their medical condition meets the requirements for disability-related service compensation. The process takes time as the VA compiles and reviews evidence from various sources. These include the opinions of family members and friends about the impact of the disability on a claimant's lifestyle and ability to work and opinions from medical experts.

Based on the severity of a medical condition is, it could take VA months to determine if there is a link between the disability and military service. It can take longer to schedule and conduct a physical evaluation, or Compensation and Pension (C&P) exam, if the claim is complex.

It is crucial that claimants present all required evidence as quickly as they can. This can speed the process of making a decision. If the VA decides that a person is eligible for disability benefits, a Rating Decision will be mailed to them. This includes an inventory of their service-connected disabilities, as well as a rating and also an effective date. It could take a few months for veterans to start receiving monthly disability checks.
