The Diffuse Mesothelioma Payment Scheme

The DMPS, a government-led scheme that compensates those with diffuse mesothelioma. The DMPS can pay out large sums when a civil suit against an employer fails due to the company no longer exists or their insurers are not traceable.

The DMPS, however, has a wide gap that means that many people are not eligible. I've represented clients who fell into these gaps and it's unfair.

What is the DMPS?

The DMPS is available to mesothelioma patients who have been diagnosed with diffuse mesothelioma payment scheme mesothelioma but are not qualified for civil compensation. The scheme provides an upfront lump sum of up to PS216.896 dependent on the patient's age at the time of diagnosis.

The DMPS is only available to those diagnosed with mesothelioma triggered by their own exposure to asbestos and who have been unable to trace their former employer or their employer's insurers. Consequently, this leaves those who have developed mesothelioma as a result of exposure to asbestos or who are not eligible to file a civil lawsuit without financial assistance.

This is a grave injustice and a difficult time for mesothelioma sufferers. It can be difficult to reconcile the fact that some patients will receive nothing at all whilst others who could have received substantial compensation through a civil claim, will be denied that money them and deposited into the DMPS.

Asbestos-related sufferers should be provided compensation that considers their particular circumstances, but not at the expense of mesothelioma sufferers from other countries. Additionally, the DMPS does not consider medical expenses such as chemotherapy or immunotherapy that might have been necessary to ease symptoms and improve life expectancy.

It is also worth noting that mesothelioma victims' ability to receive social security benefits or compensation from their DWP employer will be considered by the DMPS administrator. This is clearly a conflict of interest that shouldn't be allowed to continue.

In the event that mesothelioma sufferers pass away before making a DMPS application the right to do so is transferred to their heirs. In contrast, civil mesothelioma cases are treated differently. If someone dies before the three-year statute of limitations expires, their estate may pursue a compensation case. It is unclear why the DMPS was created on this basis. There are many questions to be asked regarding this issue. This is a subject in which I will continue to campaign for change.

How do I submit a claim?

To be eligible for a loan through the DMPS you must have been in contact with asbestos at some time. You could have been exposed to asbestos in your home or in the workplace. Workers in many different industries were exposed due to asbestos, which was widely used until it was banned. This included construction workers, tradesmen such as plumbers, electricians and carpenters as well factories workers. Asbestos dust could also affect people who lived near asbestos factories.

The DMPS was established in 2008, fills the gap left by the Pneumoconiosis Act of 1979. The scheme allowed patients with diffuse mesothelioma, who were not able to pursue a compensation claim in court, to receive a lump-sum payment. If you've lost your life due to mesothelioma, you or Mesothelioma Payment your family could receive a Special Payment between PS74,000 to PS200,000, based on your age at time of diagnosis.

Your family or you may also be eligible for other benefits, including Industrial Injuries Disablement Allowance and Disability Living Allowance. This can be used to help pay for the daily costs of living and travel expenses and equipment like oxygen tanks.

She was unable to make a claim for mesothelioma against British Uralite which was her father's former company. She was awarded only PS18,675 for the result. This was not enough to pay for her legal fees. This is an injustice. Immunotherapy therapies are promising for those suffering from mesothelioma and it is vital that those who are eligible receive the funds they need.
