According to EU directives and UK legislation, manufacturers that are not based in the EU must choose an Authorised Representative (EC Rep) and/or a UK Rep. Exceptions do exist.

What is a UK Rep?

A UK Rep is an individual or company that is designated by a product manufacturer to handle certain duties related to compliance with UK product legislation. Based on the specific product's legislation, this could include preparing UK Declarations of Conformity for medical devices and providing an initial point of contact for the MHRA (Medical Device Regulations Agency). A Responsible Person is often known as an Authorised Rep.

UK avon reps are required for companies from outside Europe who wish to sell their products on the UK market in accordance with EU directives or UK law. If an UK fulfilment service provider, shipping company or other organisation is appointed as an Authorised sales rep jobs it must also be in compliance with EU directives regarding product safety and traceability, as well as UK law.

The EU GDPR has no longer been enforceable directly in the UK due to Brexit. Businesses who wish to operate within the UK will have to adhere to the UK GDPR. How do I choose a UK Rep?

If your business is in the EU it is required to have an official representative (EU GDPR Article 3(2)). This is the case regardless of whether or there are offices in Europe. If you have no offices in the EU yet you conduct business in the EU you'll need an EU and UK representative unless you only process very small amounts of personal data of EU citizens. This is the situation if you offer goods or services to EU data subjects or monitor their actions.

If you are a non-EU entity which provides products or services to EU subjects or monitors their behavior you must designate a representative in the UK (UK GDPR Article 27). This is the case regardless of whether you are a data controller or data processor. The UK representative should be able represent your company in relation to the GDPR's obligations and also act as an interface for individuals as well as the ICO.

The UK representative needs to be a firm or organization established in the EEA and be able to represent your company in relation to its obligations under the GDPR. This is usually an independent law firm. However it could also be a private company or a consultancy. You can make the contact information of your representative easily accessible to EEA data subject by publishing them or including them in privacy notices. What are the duties of Reps from the UK? UK Rep?

How do I find the UK Rep?

UK Data Protection law stipulates that businesses located outside of the UK and offer goods or services to, or monitor the behaviour of individuals within the UK or monitor the behaviour of individuals in the UK, designate an UK representative. The person appointed is the contact point for data subjects and the ICO (Information Commissioner's Office). The appointment of the UK Representative has to be done in writing and commission must include the conditions of their relationship with you. The GDPR will not alter your liability or responsibility due to having a representative.

The requirement for a UK Representative applies to all non-EU manufacturers selling into the GB market, excluding Northern Ireland (which still requires an EU Authorised Representative). The role of the UK Rep can be taken upon by any organization that can prove their ability to comply with the requirements of the relevant product legislation and provide a reliable point of contact between the manufacturer and national market surveillance authorities and Notified Bodies. You must ensure that your UK Representative's contact information easily accessible to the individuals (individuals) who have personal data that you process. This can be done by putting them in your privacy notice or by publishing them on your website. You don't need to inform the ICO formally of your chosen representative however, their contact information should be readily available to them.
