What is a UK Representative?

What is a UK Rep?

A UK Rep is a company or person who is appointed by the manufacturer to take care of specific responsibilities related to product conformity in the UK. Based on the specific product law, this could include the preparation of UK Declarations of Conformity for medical devices, and also providing the an initial point of contact for the MHRA (Medical Device Regulations Agency). Typically, an Authorised Representative may also be called a Responsible Person.

The representative could be an individual or a business that is established in the UK and that is capable of representing the business in regards to its obligations under the UK GDPR (e.g. an individual, a private company, law firm or consultancy).

A UK Representative is a special role that requires someone who is familiar with the requirements for working with data protection authorities and handling requests from individuals. It is recommended that a company new to compliance hire an UK Rep to help with initial setup and ongoing assistance. This could include helping in the development of procedures documents, document templates, and training for Avon rep company employees.

How do I choose the UK Rep?

If your company does business in the EU, you must have an official representative (EU GDPR Article 3(2)). This requirement applies regardless of whether or there are offices in Europe. If you're a business that has no offices in the EU but operates in the EU, you must have both an EU and UK rep, unless your processing of personal data from people in the EU is limited. If you're a company that does not have offices in the EU but has business there, then you must have both an EU and UK rep unless your processing of personal data from people within the EU is very limited.

If you are an EU company that provides goods and services to EU data subject or monitors their behaviour You must appoint a person from the UK. (UK GDPR article 27). This requirement applies regardless of whether you're a controller of data, or a processor. The UK representative must be able to represent your company in relation to the obligations you have under the GDPR and also act as a local point of contact for individuals and the ICO.

The UK representative must be a company, or an organisation, based in the EEA and able of resolving the company's obligations under GDPR. Typically, this is an independent law firm, however it could also be a consulting or private company. You can make the contact information of your representative easily accessible to EEA data subject by publishing them or including them in privacy notices. This will allow data subjects from the EEA to reach out to the representative with their concerns about your business's handling of their personal information.

You must name your representative in writing and set out the conditions of their relationship, much like a service contract. What are the duties of a UK Rep?

However, UKRPs have more responsibilities. UKRP is more accountable in relation to the UK's newly-introduced Medical Device Regulation (MDR). For instance, a UKRP is accountable for registering devices with the MHRA and acting as a liaison between the manufacturer and MHRA. In addition, a UKRP is responsible to ensure compliance with the MDR.

A union rep, also known as a Steward, has statutory rights to represent their members at work and carry out other duties at work. Typically, they are appointed by the relevant members and may be voted for via a meeting or ballot. The appointment is usually notified to the employer by the union.

Holiday companies employ holiday reps in their resorts abroad as well as in the UK during the summer months. Representatives are trained in the UK and then transferred to their resorts. How do I find an UK Rep?

UK Data Protection law requires that companies that are located outside of the UK and provide services or goods to or monitor the actions of, people who reside in the UK, appoint the position of a UK representative. This person is the main contact between data subjects and ICO (Information Commissioner's Office). The appointment of the UK Representative has to be done in writing, and must state the conditions of their relationship with you. The GDPR will not alter your liability or responsibility because of having a Representative.

All manufacturers from outside the EU that sell their products to the GB Market are required to have an UK representative, with the exception of Northern Ireland. Northern Ireland still requires an EU Authorised Rep. The function of the UK Rep can be taken upon by any organization that can prove their ability to fulfil the requirements of relevant legislation governing the product and serve as an effective point of contact between the manufacturer and national market surveillance authorities and Notified Bodies. In the case of medical devices, a representative authorized would be a reputable Certification Company. For other products, it could be the distributor or sales rep jobs agent.

You must make the details of your selected UK Representative accessible to the data subjects (individuals) whose personal data you process and make them easily accessible. You can do this by including the details in your privacy notice or publishing the information on your website. It is not necessary to notify the ICO of your representative however their contact information must be easily accessible to them.
