What is a UK Representative?

What is a UK Rep?

A UK Rep is a person or company that is designated by a manufacturer of a product to handle certain duties related to compliance with UK product legislation. In accordance with the specific product law such as drafting UK Declarations of Conformity (DCC) for medical devices, or being the initial point of contact with the MHRA. Typically, an Authorised Representative is called a Responsible Person.

UK Reps are required for non-European companies who want to sell their products on the UK market in conformity with EU directives or UK laws. If you are a UK fulfilment service provider, shipping company or other organisation is appointed as an Authorised Rep it must also be in compliance with EU directives regarding product safety and traceability as well as UK law.

With the Brexit and the departure of the EU GDPR, the EU GDPR is no longer directly applicable in the UK and therefore companies that want to establish operations in the UK must comply with a new set of data protection laws known as the UK GDPR. The UK regulations are similar to the EU GDPR but are adapted so that they can be enforced by the Information Commissioner's Office.

Under the UK GDPR, it is necessary for organisations established outside of the EU to designate a representative in the UK to ensure they can communicate with the authorities in charge of data protection and with individuals within the UK. How do I nominate a UK Rep?

Any organisation can take on the responsibility of UK Rep, as long they can show that they are able to meet the requirements of relevant product legislation and providing an effective point of contact between the manufacturer and the national market surveillance authorities or Notified Bodies. You must make the details of your chosen UK Representative available to data subjects (individuals) who have personal information you handle and make them easy to locate.
