What is an UK Rep?

A UK Rep is a company or person who is designated by the manufacturer to take care of certain duties related to product conformity in the UK. Based on the specific legislation applicable to the product, it may include drafting UK Declarations of Conformity (DCC) for medical devices, or serving as the initial point of contact with the MHRA. Typically, an Authorised Representative may also be known as a Responsible Person.

UK Reps are required for companies from outside Europe who wish to sell their products on the UK market in conformity with EU directives or UK laws. If you are a UK fulfilment service provider or shipping company, or any other organization is designated as an Authorised Rep it must also comply with EU directives regarding product safety and traceability, as well as UK law.

With the Brexit that took place, the EU GDPR is no longer applicable in the UK and therefore companies that want to operate in the UK must adhere to the new data protection laws referred to as the UK GDPR. This requirement applies regardless of whether you are a data controller or a data processor. The UK representative should be able represent your business in relation to your obligations under GDPR and act as a point of contact for individuals as well as the ICO.

The UK representative has to be a company or organisation established within the EEA, and be able to represent your company in relation to its obligations under the GDPR. Typically it is an independent law firm, but it could also be a consultancy or private firm. You can make the contact information of your representative easily accessible to EEA data subjects by publishing or UK Rep including privacy notices. A union rep or steward has the same statutory rights as a union representative. They are able to represent their members and perform other duties at work. Typically, they are appointed by the relevant members and may be voted for via a meeting or ballot. The union is usually the one to inform the employer of the appointment.
