What is Black Lung Disease?

Black lung is caused by prolonged exposure to coal dust. This causes scarring of the lungs which interferes with their capacity to exchange carbon dioxide for oxygen. It is also referred to as Coal Workers Pneumoconiosis.

BNSF moved for summary judgment, asserting that Harrah's 2017 Release fully resolved her claims under FELA. Payne did not dispute this, meaning that the release was in fact valid.

Signs and symptoms

The black sputum can be one of the signs of black lung. The sputum comes from scarring of the lungs that hinders oxygen from entering the bloodstream. This makes the lungs work harder. Scarring can also make someone feel exhausted or experience breathing problems. The symptoms can occur following vigorous exercise or even at sitting down. They are more likely to appear after smoking or after exposure to certain chemicals and fumes.

Workers are at a greater risk of developing lung cancer if they are exposed to asbestos which is commonly found in brakes and other parts on trains.

Diagnosis

She claimed that the railway company had violated their duty to provide Harrah an environment of safety and warn her about the dangers of asbestos, and adhere to the rules of the road.
