What caused the accident

In the 1920s, Louisiana utility entrepreneur Harvey Couch began acquiring railways, merging them under his control. Giddens counsel also claimed that this was KCS's responsibility to be aware of the applicable OSHA regulations and follow them. This argument was not challenged by KCS or its expert witnesses.

Who is at fault?

A train that crosses a road is among the most dangerous intersections in our society. If a car is involved in a collision with trains, the passengers and the driver can suffer serious injuries.

The accident occurred at the intersection of East Iowa Road with the KCS tracks in Beauregard Parish. Lloyd Mitchell was driving a van that was carrying three girls to their homes after church services when the train struck them. The accident killed the oldest girl, Amanda Duncan, who was 12 years old. Rachel and Myranda were both injured but survived.

Plaintiffs contend that the railroad failed to properly clear its right of way at the crossing, resulting in inadequate visibility distances. They also claim that the railroad did not place adequate warning signs which are required by law. The trial court determined that KCS violated its duty to maintain its tracks, to maintain adequate sight distances, and to provide warning signs and that this violation was the cause of the accident.

Mike Haverty became CEO of KCS when the Western railroads were combined under the mega-systems BNSF and Union Pacific in 1995. He believed KCS could keep its independence by doubling its northern-southern roots. He began to acquire tracks of the L&A and LR&N, and when the company purchased the Texas Mexican Railway, it created a single north-south railroad that was able to compete with the two super-systems.
